The Runaway Doctor

Theodoros & Rooth, P.C., founder Barry D. Rooth played a key role in a case involving Dr. Mark Weinberger, M.D., dubbed “The Runaway Doctor” by Vanity FairIn this highly publicized case, Barry represented over 280 plaintiffs against Weinberger, who was accused of performing hundreds of unnecessary surgeries for financial gain. In 2004, Weinberger disappeared without a trace. It was five years before he was found, living in the Alps near Courmayeur, Italy. Extradited to the United States, he plead guilty to 22 counts of health care fraud. Barry secured a global settlement for his clients from the Indiana Patient’s Compensation Fund.

Spinal Surgeon Accused of Kickbacks

In a whistleblower retaliation claim Theodoros & Rooth, P.C. is involved in, a Northwest Indiana surgeon is accused of accepting kickbacks from a spinal surgery device manufacturer from 2012 to 2018. In exchange for dubious royalty, intellectual property and consulting fees, the physician used more than $22.9 million worth of the company’s products on his patients — far more than any other of the manufacturer’s customers. Four former employees of the manufacturer, Life Spine, came forward with the lawsuit in 2018.
