The Runaway Doctor

 

 

Theodoros & Rooth, P.C., founder Barry D. Rooth played a key role in a case involving Dr. Mark Weinberger, M.D., dubbed “The Runaway Doctor” by Vanity Fair. In this highly publicized case, Barry represented over 280 plaintiffs against Weinberger, who was accused of performing hundreds of unnecessary surgeries for financial gain. In 2004, Weinberger disappeared without a trace. It was five years before he was found, living in the Alps near Courmayeur, Italy. Extradited to the United States, he plead guilty to 22 counts of health care fraud. Barry secured a global settlement for his clients from the Indiana Patient’s Compensation Fund.

Case Results

Theodoros & Rooth  (alongside CohenMalad, LLP and the Indiana Commissioner of Insurance) represented 282 former patients injured by Dr. Weinberger. These clients alleged unnecessary sinus surgeries and negligent procedures. The settlement was approved by Judge Pera of Lake Superior Court in Crown Point, Indiana
