$66.5 Million Settlement Reached in Medical Malpractice Case

In a whistleblower retaliation claim Theodoros & Rooth, P.C. is involved in, a Northwest Indiana surgeon is accused of accepting kickbacks from a spinal surgery device manufacturer from 2012 to 2018. In exchange for dubious royalty, intellectual property and consulting fees, the physician used more than $22.9 million worth of the company’s products on his patients — far more than any other of the manufacturer’s customers. Four former employees of the manufacturer, Life Spine, came forward with the lawsuit in 2018.

The Runaway Doctor Case

Theodoros & Rooth  (alongside CohenMalad, LLP and the Indiana Commissioner of Insurance) represented 282 former patients injured by Dr. Weinberger. These clients alleged unnecessary sinus surgeries and negligent procedures. The settlement was approved by Judge Pera of Lake Superior Court in Crown Point, Indiana

As Vanity Fair writes about Doctor Mark Weinberger: “People can say all they want about him: that hundreds of patients in northwestern Indiana are walking around with worthless holes in their sinuses which he put there using an outdated surgical procedure, and that he has billed insurance companies for a myriad of operations that one medical expert says he could only have performed with “twelve hands” in the 25 minutes his notes indicate the surgeries took. “He mutilated people for money” is the way trial lawyer Barry Rooth will ultimately describe his practice in a court proceeding.”
